On April 11, 2023, the Minister of Culture, Sports, and Tourism issued Decision No. 912/QĐ-BVHTTDL, stipulating the functions, duties, powers, and organizational structure of the Copyright Office of Vietnam.
Position and functions of the Copyright Office of Vietnam
The Copyright Office of Vietnam (COV) is an administrative body under the Ministry of Culture, Sports, and Tourism.
The Copyright Office functions as an advisory unit, assisting the Minister of Culture, Sports, and Tourism in the following areas:
– Protecting copyright, related rights, and cultural industries nationwide.
– Managing public services related to the protection of copyright and related rights.
The Copyright Office has its own official seal and a bank account with the State Treasury.
Duties and powers of the Copyright Office of Vietnam
1. Draft legal documents and other materials related to copyright, related rights protection, and the development of other cultural sectors; submit to the Minister of Culture, Sports, and Tourism for approval and implement once authorized.
2. Guide the provision, cooperation, commissioning, usage, and assurance of copyright and related rights in accordance with the law.
3. Protect the rights of organizations and individuals regarding copyright and related rights; implement measures to develop other cultural sectors.
4. Manage and exploit copyright and related rights where the State is the representative owner or manager; receive transfers of copyright and related rights from organizations and individuals to the State.
5. Advise on training and professional inspections related to copyright, related rights, and cultural industry development.
6. Manage collective copyright management organizations, consulting, and service organizations related to copyright and related rights.
7. Oversee and implement activities related to copyright and related rights expertise; issue, renew, and revoke expert identification cards and certificates for expertise organizations in accordance with the law.
8. Manage the issuance of copyright registration certificates and related rights registration certificates.
9. Promote and disseminate knowledge about copyright, related rights, and the development of cultural industries.
10. Organize information, media, statistical, and publishing activities related to copyright, related rights, and cultural industries.
11. Inspect, resolve complaints, conduct investigations, and address violations related to copyright and related rights.
12. Recommend rewards for achievements in copyright protection, related rights, and the development of cultural industries.
13. Participate in international cooperation and integration activities related to copyright, related rights, and cultural industries as assigned by the Minister of Culture, Sports, and Tourism.
14. Manage the approval of translating works from foreign languages into Vietnamese and copying works for non-commercial purposes.
15. Manage the exploitation and use of published works, recordings, and videos with unidentified owners.
16. Advise on fee schedules and payment methods for royalties through collective copyright management organizations.
17. Advise on general policies, regulations, and programs for intellectual property protection.
18. Advise on general policies, regulations, and programs for the development of cultural industries.
19. Advise on the implementation of the Strategy for Cultural Industry Development.
20. Implement administrative reform and digital transformation programs in line with the Ministry’s plans.
21. Organize personnel management and implement policies for staff under the Vietnam Copyright Office.
22. Manage financial operations in compliance with the law.
23. Carry out other assigned tasks.
Organizational structure of the Copyright Office of Vietnam
1/ Director and Deputy Directors:
The Vietnam Copyright Office is led by a Director and Deputy Directors, who are responsible for overseeing the agency’s operations.
2/ Professional and operational departments:
a) Office of the Copyright Office: Handles administrative and organizational tasks.
b) Department of Copyright and Related Rights Management and International Cooperation: Manages and oversees activities related to copyright, related rights, and international partnerships.
c) Department of Cultural Industry Management: Responsible for the regulation and development of cultural industries.
d) Department of Copyright and Related Rights Registration: Handles the registration process for copyright and related rights.
3/ Public non-business unit under the Copyright Office
Center for Expertise, Information, and Copyright Transfer: Provides services related to the evaluation, information dissemination, and transfer of copyright and related rights.
The Director of the Vietnam Copyright Office is accountable to the Minister of Culture, Sports, and Tourism and to the law for carrying out the assigned tasks and powers. The Director is responsible for defining the functions, duties, and organizational structure of the specialized departments and the public non-business unit. Additionally, the Director manages the staffing of civil servants, public employees, and workers based on the professional and technical standards required by the respective departments and the public non-business unit. The Director also drafts and issues the Regulations on the organization and operation of the Office.
