This is a violation of the law and is strictly punished under Vietnamese law.

How Many Years in Prison for the Crime of Organizing Online Gambling in Vietnam?

The crime of organizing gambling is stipulated in Article 322 of the 2015 Penal Code (amended and supplemented in 2017).

Clause 2, Article 322 of the Penal Code states:

Offenders committing the crime in one of the following circumstances shall be sentenced to 05 to 10 years of imprisonment:

a) Conducting the crime in a professional manner;

b) Illegally earning 50,000,000 Vietnamese dong or more;

c) Using the internet, computer network, telecommunications network, or electronic means to commit the crime;

d) Committing the crime in a dangerous recidivism manner.

According to Point c, Clause 2, Article 322 of the Penal Code, the crime of organizing online gambling can result in a prison sentence of 05 to 10 years.

Additionally, according to Clause 3 of this Article, individuals convicted of organizing online gambling can also be subject to an additional fine of up to 100 million Vietnamese dong or the confiscation of part or all of their property.

Factors Affecting the Punishment for the Crime of Organizing Online Gambling in Vietnam

Nature and Severity of the Violation: The seriousness of the act of organizing online gambling, the scale of the gambling organization, and the amount of money involved.

Role in the Gambling Organization: The punishment framework varies according to each person’s level of participation in the criminal organization. The leader of the organization will always receive a heavier sentence compared to those who play supporting roles.

Aggravating Circumstances: The punishment for organizing gambling will also depend on any aggravating circumstances. For example, organized crime, repeated offenses, or using sophisticated methods to commit the crime.

Mitigating Circumstances: If the person convicted of organizing online gambling has mitigating circumstances, the court may consider reducing the sentence. Mitigating circumstances can include: sincere confession, remorse, voluntary compensation for damages, self-reporting, and surrendering.
