At this stage, the IP VIETNAM will review whether the file is complete and valid based on formal criteria. The aspects checked include: whether the application form is correctly filled out, the information about the trademark owner, whether the trademark sample is clear and easily identifiable, whether the list of products or services aligns with the appropriate classification, and whether the accompanying documents are complete and comply with the requirements. The formal examination process typically takes 3 to 4 months from the submission date. If the application is invalid, the VIPO will notify the applicant to make corrections within the specified time frame. If the applicant fails to make the necessary changes within the deadline, the application may be rejected.

Once the application passes the formal examination, it will be published in the Industrial Property Gazette within 2 months from the date the application is accepted as valid. The published information will include details about the trademark, the applicant’s name and address, the application number and filing date, and the list of goods or services being registered. The publication of the application is a crucial step to ensure transparency and allow third parties to file objections if they believe the trademark violates their rights. This publication process also provides an opportunity for businesses to check for potential disputes and take necessary actions before entering the substantive examination phase.

Substantive Examination

Substantive examination is one of the most important and complex steps in the trademark registration process. After the trademark application has passed the formal examination and been published in the Industrial Property Gazette, it will proceed to the substantive examination phase. The purpose of this step is to assess whether the trademark qualifies for registration, based on trademark protection laws.

During the substantive examination, IP Vietnam will conduct a thorough review of the trademark’s distinctiveness. Specifically, the trademark must meet requirements such as: not being identical or confusingly similar to previously registered trademarks, not violating public morals, public order, or national interests. To perform this, examiners will search and compare the trademark against others that have been registered within the same class of goods or services. If the trademark is deemed confusing or similar to a prior protected trademark, the application may be rejected.

Additionally, the trademark will be checked for its ability to distinguish it from other common signs. For example, trademarks consisting of words that merely describe the product or service (such as “white paper,” “premium paper”) may not be accepted because they lack distinctiveness from similar products offered by other businesses.

The substantive examination process typically takes between 12 to 18 months, depending on the number of applications filed and the complexity of each case. During this period, if any issues with the trademark are found, IP Vietnam will notify the applicant and request explanations or amendments to meet the protection requirements.

At the end of the substantive examination, if the trademark meets all the protection conditions, IP Vietnam will issue a decision to grant the trademark registration certificate to the applicant. If the trademark does not meet the requirements, IP Vietnam will refuse protection and inform the applicant of the reasons for the refusal. Issuance of Trademark Registration Certificate
