What Are Business Sectors Subject to Conditional Market Access for Foreign Investors?

Business sectors subject to conditional market access are sectors in which Vietnamese law permits foreign investors to invest, provided that they satisfy one or more statutory conditions before or during the course of their investment.

These conditions may include restrictions on the maximum foreign ownership ratio in a Vietnamese enterprise, specific investment structures, requirements relating to the investor’s financial capacity, professional qualifications, or business experience, as well as other conditions prescribed by applicable laws and regulations.

According to Decree No. 96/2026/ND-CP, issued by the Government on 31 March 2026, there are 62 business sectors subject to conditional market access for foreign investors in Vietnam.

List of Business Sectors Subject to Conditional Market Access for Foreign Investors

According to Decree No. 96/2026/ND-CP, the following business sectors are subject to conditional market access for foreign investors in Vietnam:

1/ Production and distribution of cultural products, including video recordings.

2/ Production, distribution, and exhibition of television programs, as well as musical, theatrical, and cinematographic works.

3/ Radio and television broadcasting services.

4/ Insurance, banking, securities trading, and other services related to insurance, banking, and securities.

5/ Postal and telecommunications services.

6/ Advertising services.

7/ Printing services (excluding the printing of packaging without product labels) and publication distribution services.

8/ Surveying and mapping services.

9/ Aerial photography services.

10/ Educational services.

11/ Exploration, extraction, and processing of natural resources, minerals, oil, and gas.

12/ Hydropower, offshore wind power, and nuclear energy.

13/ Freight and passenger transportation by rail, air, road, inland waterways, sea, and pipeline.

14/ Aquaculture.

15/ Forestry and hunting.

16/ Betting and casino businesses.

17/ Security services.

18/ Construction, operation, and management of inland water ports, seaports, and airports.

19/ Real estate business.

20/ Construction activities carried out by foreign contractors.

21/ Legal services.

45/ Cultivation, production, or processing of rare and precious plant species; breeding of rare and endangered wild animals; and the processing or handling of such plants and animals, including live animals and products derived from them.

49/ Services related to sports, fine arts, performing arts, fashion shows, beauty and model contests, and other entertainment and recreational activities.

51/ Shipping agency services and ship towage services.

52/ Services relating to cultural heritage, copyright and related rights, photography, filming, sound recording, art exhibitions, festivals, libraries, and museums.

53/ Tourism promotion and marketing services.

54/ Representation, talent agency, booking, and management services for artists and athletes.

55/ Family-related services.

56/ Operation and management of intermediary e-commerce platforms, social networking platforms engaged in e-commerce activities, and integrated e-commerce platforms.

57/ Cemetery business, cemetery services, and funeral services.

58/ Aerial seeding and aerial chemical spraying services.

59/ Maritime pilotage services.

60/ Investment sectors operating under pilot mechanisms approved by the National Assembly, the Standing Committee of the National Assembly, the Government, or the Prime Minister.

61/ Manufacture and trading of weapons, explosives, and supporting tools.

62/ Manufacture of military materials or equipment; trading of military uniforms and supplies for the armed forces; military weapons; military and police equipment, technology, specialized vehicles, components, spare parts, materials, specialized equipment, and technologies used for their manufacture.
