In accordance with the regulations of Decree No. 13/2013/ND-CP of the Government of Vietnam on personal data protection, within 60 days from the date of transferring personal data abroad, organizations and individuals must submit a notification along with the impact assessment file for transferring personal data abroad to the Cyber Security and High-tech Crime Prevention Department under the Ministry of Public Security.
The file of the impact assessment of transferring personal data abroad includes:
1. Notification of the impact assessment of transferring personal data abroad.
2. Copy of the Certificate of Business Registration or Business License (for organizational profile owners) or a copy of the Citizen Identification Card or Passport (for individual profile owners).
3. The file of the impact assessment of transferring personal data abroad.
4. Copy of the Contract or relevant document related to the agreement on transferring personal data abroad with the parties involved (if any).
5. Copy of the Decision or documents related to the assignment of the department responsible for transferring personal data abroad by the profile owner.
6. Copy of other documents, including annexes, cost calculation spreadsheets, benefits of solutions, etc.
